Limitation of Liability:
Except where prohibited by law, in no event will Apple be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Apple has been advised of the possibility of such damages. Limitations of liability are invariably, and quite properly, included in contracts dealing with the supply of software. Even as the exclusion clause seeks to exclude the supplier’s liability for various types of loss which might otherwise be recoverable (for example, consequential loss), the limitation of liability stands sentry against the supplier’s purse strings, ensuring that sums recoverable in respect of any losses for which the supplier cannot avoid liability, are limited to an agreed amount.. If applicable law does not allow all or any part of the above limitation of liability to apply to you, the limitations will apply to you only to the extent permitted by applicable law.

Exclusion of Warranty:
Warranty represents an unfulfilled opportunity to improve the profitability of our company. This is a bold statement until you consider the cash that can be freed from your warranty reserves, the claim costs you can recover when your supplier is responsible, and the reduction in total processing costs that can be achieved through warranty policy management. This warranty is expressly in lieu of any other warranties, express or implied, in connection with the design, sale, merchantability or fitness of the equipment for particular purpose or use, effective warranty policy management must be a collaborative effort between suppliers, OEMs, and customers. To accomplish this ITB Warranty Management delivers a comprehensive set of applications to address the claims administration, parts returns, and supplier recovery processes.
